Terms of Service

1. Introduction 1.1 These General Terms and Conditions (the "Terms") apply to every use of the Fofop website and to all orders placed through our online store.

2. Acceptance of the Terms 2.1 By using our website or placing an order with Fofop, you confirm that: (a) you are a natural person at least 18 years of age; (b) you have full legal capacity to enter into a binding contract; and (c) there are no legal or contractual obstacles preventing you from entering into a contract with us. 2.2 Fofop reserves the right to ask you for written confirmation of your authority to accept these Terms. 2.3 You further warrant that you have not been convicted of offenses related to online activity and that you have not previously been excluded from our services. 2.4 Fofop has the right to restrict access to the website if this is necessary to protect the service or required by law. 2.5 By placing an order, you confirm that you have read, understood, and fully accept these Terms and the Privacy Policy.

3. Use for private purposes You declare that you use the Fofop online store solely as a consumer for private purposes. Reselling the products for commercial purposes without Fofop's consent is prohibited.

4. Prices and additional costs 4.1 All prices on the Fofop website are stated in US dollars (USD) and are gross prices (including VAT at the rate of 23%). 4.1a United States: For orders delivered to the United States, prices are also stated in US dollars (USD). Polish VAT does not apply to these orders. The price shown at checkout is the total amount payable, and no additional charges apply after purchase. 4.2 Delivery: Within Poland, delivery is always free of charge. The total amount shown in the order summary is the final amount the customer is obliged to pay. 4.3 International orders: In the case of shipping outside the territory of the European Union, the customer may be obliged to pay customs duties or local import taxes. This does not apply to orders delivered to the United States: no customs duties or import charges are payable by the customer for US deliveries, in accordance with section 4.1a and our Shipping Policy. 4.4 Fofop makes every effort to ensure that prices are correct. In the event of an obvious pricing error, we reserve the right to cancel the order and fully refund the amounts paid.

5. Order and confirmation 5.1 After placing an order, you will receive an e-mail confirming that your order has been received. 5.2 A binding contract of sale is concluded at the moment you receive a second e-mail confirming that your order has been accepted for fulfillment. 5.3 We reserve the right to refuse to fulfill an order in the event of suspected fraud or technical errors.

6. Payment 6.1 Secure payment methods are available: payment cards (Visa, Mastercard, Maestro, Amex) and all major credit cards, PayPal, BLIK, Apple Pay, Google Pay, and Shop Pay. 6.2 All transactions are encrypted with an SSL certificate. 6.3 The customer undertakes not to initiate unjustified chargeback procedures.

7. Delivery 7.1 Products are delivered to the address indicated in the order form. 7.2 The estimated delivery time is stated with each product. 7.3 The risk of damage passes to the customer at the moment of physical receipt of the shipment.

8. Cancellation or change of an order 8.1 Cancellation is possible only until shipping processing has begun. Contact us immediately at info@byfofop.com.

9. Complaints (Defective products) 9.1 If you receive a defective product, you have the right to file a complaint. Contact us and send photos of the defect. 9.2 If the complaint is accepted, we offer an exchange for a new product or a full refund of the payment.

10. Right of withdrawal from the contract (Returns) 10.1 Under EU law, you have 14 days to make a return. Fofop voluntarily extends this period to 30 days. 10.2 The product must be in undamaged condition, in its original packaging. 10.3 The cost of the return shipment is borne by the Buyer, unless the reason for the return is a defect in the product. 10.4 The refund is made within 7 business days from the moment the return shipment has been verified, using the same payment method.

11. Discount codes and gift vouchers 11.1 Fofop may offer discount codes or gift vouchers as part of marketing campaigns. 11.2 Discount codes must be entered on the order summary page before making payment. 11.3 Only one discount code may be used per order, unless the terms of a specific promotion state otherwise. 11.4 Discount codes cannot be exchanged for cash. 11.5 In the event of a return of a product purchased using a code, only the amount actually paid is refunded.

12. Permitted use of the website 12.1 The Fofop website may be used only for lawful purposes. In particular, the following are prohibited: (a) undertaking activities of an illegal nature or promoting crime; (b) distributing malicious software, viruses, or Trojan horses; (c) automated data harvesting (scraping) without our express consent; (d) interfering with the operation of servers and network infrastructure; (e) violating the instructions contained in the robots.txt file. 12.2 The user bears full liability for any damage resulting from a breach of the above rules.

13. Links to third-party websites 13.1 Our website may contain links to external services. 13.2 Fofop has no control over the content of those websites and is not responsible for their privacy policies or content. 13.3 You may link to our home page provided that you do so in a fair way, do not infringe our personal rights, and do not suggest any partnership without our consent.

14. Intellectual property 14.1 All content published on the website (texts, graphics, logos, photographs, source code) constitutes the intellectual property of Fofop or its licensors. 14.2 Copying, modifying, or distributing any elements of the website for commercial purposes without Fofop's written consent is prohibited. 14.3 Content may be downloaded solely for personal use related to purchases in our store.

15. Protection of personal data 15.1 Personal data is processed in accordance with our Privacy Policy, which forms an integral part of these Terms. 15.2 Data is processed for the purpose of fulfilling orders and, with the user's consent, for marketing purposes. 15.3 We use modern security techniques to protect your data against unauthorized access.

16. Security and viruses 16.1 Fofop makes every effort to keep the website free of errors and viruses, but we cannot fully guarantee this. 16.2 The user is responsible for having up-to-date antivirus software on their devices. 16.3 Attacks on our infrastructure (e.g., DDoS) will be immediately reported to the appropriate law enforcement authorities.

17. Limitation of liability 17.1 Fofop is not liable for slight differences in product colors resulting from the settings of the user's monitor. 17.2 We are not liable for damage resulting from interruptions in internet or power supply, or for errors resulting from incorrect data provided by the customer. 17.3 Fofop's liability toward the customer is limited to the amount of the price actually paid for the purchased product.

18. Release from liability (Indemnification) 18.1 The user agrees to indemnify and hold Fofop harmless from any third-party claims arising from the user's breach of these Terms or of the law.

19. Force majeure 19.1 We are not liable for non-performance or improper performance of obligations if it results from force majeure events (e.g., natural disasters, pandemics, strikes, wars). 19.2 If the force majeure lasts longer than 14 days, both parties have the right to terminate the contract without contractual penalties.

20. Changes to the Terms 20.1 Fofop reserves the right to amend the Terms. Amendments take effect on the day they are published on the website. 20.2 Orders placed before an amendment to the Terms are fulfilled on the basis of the version in force on the day of purchase.

21. Violation of the Terms 21.1 If a violation of the Terms is found, Fofop may: (a) send a warning to the user; (b) temporarily or permanently block access to the account; (c) cancel orders that raise a reasonable suspicion of fraud.

22. Governing law and dispute resolution These Terms are governed by Polish law. The consumer has the right to use out-of-court methods of complaint resolution through the ODR platform: http://ec.europa.eu/consumers/odr. For consumers in the United States, nothing in these Terms deprives you of mandatory consumer protections you are entitled to under the laws of your state of residence.
